These Terms of Use apply to the Newcomer Circle NL website and to products and services purchased through this website.

By using this website or placing an order, you agree to these Terms and Conditions.

1. About Newcomer Circle NL

Newcomer Circle NL is an educational platform operated by Cindy Colijn in the Netherlands.

2. Scope of these Terms

These Terms and Conditions apply to:

  • use of the Newcomer Circle NL website;
  • purchases of digital products;
  • access to downloadable educational materials;
  • future digital lessons, courses, practice materials, or memberships where these Terms are referenced;
  • communication connected to an order or customer account.

Any additional terms shown on a specific product page also form part of the agreement for that product.

3. Educational purpose

Newcomer Circle NL provides educational and practical information for Dutch-language learners and newcomers to the Netherlands.

The information is intended for general educational purposes only. It is not legal, immigration, tax, employment, medical, or other professional advice.

Rules, procedures, examination requirements, and government information may change. Customers remain responsible for checking important information with the relevant authority or qualified professional.

4. Product information

The main characteristics of each product are described on the relevant product page before purchase.

Product information may include:

  • the product title;
  • format;
  • language level;
  • included materials;
  • price;
  • access method;
  • delivery method;
  • technical requirements;
  • whether the product is a one-time purchase or recurring service.

Customers should review the product description carefully before ordering.

5. Complete Dutch Grammar eBook

The Complete Dutch Grammar eBook is supplied as a downloadable PDF for personal educational use.

Customers need:

  • an internet connection to download the file;
  • a compatible computer, tablet, or phone;
  • software capable of opening PDF files;
  • a valid email address.

Colours, page appearance, spacing, and formatting may vary depending on the customer’s screen, device, PDF reader, or printer.

6. Prices

Prices are displayed in euros unless otherwise stated.

The total amount payable is shown before the customer completes checkout.

Where applicable, taxes are included or calculated according to the information displayed during checkout.

Newcomer Circle NL may change prices at any time. A price change does not affect an order that has already been successfully completed.

Obvious pricing or technical errors may be corrected. Where an order is affected by a clear error, the customer will be contacted and offered an appropriate solution.

7. Payment

Payments are processed securely through third-party payment providers, including Stripe.

Available payment methods may include:

  • credit or debit card;
  • iDEAL;
  • Apple Pay;
  • Google Pay;
  • Link;
  • other methods offered at checkout.

The available methods may depend on the customer’s country, currency, browser, device, and payment-provider eligibility.

An order is completed only after payment has been successfully authorised.

Newcomer Circle NL does not store complete card numbers or online-banking login details.

8. Order confirmation

After a successful order, the customer will normally receive an order confirmation by email.

The customer is responsible for entering a correct and accessible email address during checkout.

Customers should also check their spam or junk folder when an expected email does not arrive.

An automated confirmation does not prevent an order from being corrected or cancelled where there has been fraud, misuse, a technical error, or an obvious pricing mistake.

9. Delivery of digital products

Digital products are normally made available shortly after successful payment.

Access may be provided through:

  • a download link on the confirmation page;
  • a product-access email;
  • the customer account or customer portal;
  • another access method described on the product page.

Customers are responsible for downloading and safely storing purchased files.

Please include the name and email address used for the order.

10. Immediate delivery and the right of withdrawal

Consumers ordinarily have a 14-day right of withdrawal for many online purchases.

For digital content that is not supplied on a physical medium, the right of withdrawal may end after delivery begins when the customer:

  1. expressly requests immediate delivery before the end of the withdrawal period; and
  2. acknowledges that the right of withdrawal will be lost once delivery begins.

Before completing the purchase, the customer may therefore be asked to agree to immediate access and acknowledge the loss of the withdrawal right.

Where valid consent and acknowledgement have been provided, the customer loses the right to withdraw once access to the digital content or download begins.

This does not affect legal rights where the digital product is defective, inaccessible, corrupted, or materially different from its description.

11. Refunds

Because digital products can be accessed or downloaded immediately, refunds are not normally provided merely because a customer:

  • changes their mind after access has begun;
  • no longer needs the product;
  • purchased the wrong item without first reviewing the description;
  • did not complete the material;
  • expected a different learning result.

A refund, replacement file, renewed access, or another appropriate solution may be provided where:

  • the customer was charged more than once;
  • the wrong product was delivered;
  • the file is corrupted;
  • the download link does not work;
  • access was not provided after successful payment;
  • the product is materially different from its description;
  • a refund is required by applicable consumer law.

Please include the order email, order date, product name, and a clear description of the problem.

12. Defective digital content

Digital products must conform to their description and work as customers may reasonably expect, taking account of the product information and technical requirements.

Where digital content is defective, Newcomer Circle NL may first attempt to:

  • restore access;
  • provide a replacement file;
  • correct the problem;
  • provide reasonable technical assistance.

Where the problem cannot be resolved within a reasonable period, the customer may be entitled to an appropriate price reduction, cancellation, or refund under applicable law.

Nothing in these Terms limits mandatory legal consumer rights.

13. Personal-use licence

Purchasing a digital product gives the customer a limited, personal, non-exclusive, non-transferable licence to use it.

The customer may:

  • download the product for personal use;
  • save it on personal devices;
  • print one or more copies for their own study;
  • use the material for personal learning.

The customer may not:

  • share the file or download link with another person;
  • upload the product to a website, cloud-sharing platform, group, or social-media channel;
  • resell, rent, sublicense, or redistribute the product;
  • reproduce substantial parts for commercial purposes;
  • use the material to create a competing product;
  • remove copyright, attribution, or ownership notices;
  • provide access to students, clients, employees, or organisation members without permission.

Tutors, schools, employers, and organisations requiring multi-user access must request separate written permission or an appropriate licence.

14. Intellectual property

Unless otherwise stated, all rights in the website and educational materials belong to Cindy Colijn, Newcomer Circle NL, or the relevant rights holder.

This includes:

  • written content;
  • eBooks;
  • exercises;
  • dialogues;
  • visual grammar materials;
  • graphics;
  • illustrations;
  • downloadable files;
  • branding;
  • logos;
  • page designs;
  • course and lesson content.

Purchasing or accessing a product does not transfer ownership of the intellectual property.

No content may be reproduced, distributed, adapted, translated, published, or commercially exploited without prior written permission, except where permitted by law.

15. Customer accounts and access

Some products or services may require a customer account.

Customers are responsible for:

  • providing accurate information;
  • keeping login details secure;
  • not sharing account access;
  • notifying Newcomer Circle NL of suspected unauthorised use.

Access may be suspended where there is reasonable evidence of:

  • unauthorised sharing;
  • fraud;
  • payment reversal;
  • misuse of content;
  • disruption of the website;
  • a serious breach of these Terms.

16. Future courses, lessons, and memberships

Newcomer Circle NL may later provide digital lessons, practice materials, courses, memberships, or paid-access areas.

The product page will state:

  • what is included;
  • the access period;
  • whether payment is one-time or recurring;
  • whether free and paid content are available;
  • any specific cancellation conditions.

Recurring payments will not be charged unless the customer has clearly agreed to a subscription or recurring arrangement.

Additional product-specific conditions may apply and will be shown before purchase.

17. Reviews

Customers may be invited to submit reviews.

Reviews must reflect genuine experiences and must not contain:

  • false or misleading information;
  • unlawful content;
  • threats or harassment;
  • discriminatory or abusive language;
  • personal information about another person;
  • advertising or spam;
  • copyrighted material used without permission.

Newcomer Circle NL may refuse or remove reviews that breach these requirements.

Reviews will not be edited in a way that changes their meaning.

18. Website availability

Reasonable efforts are made to keep the website, checkout, and digital products available.

Temporary interruptions may occur because of:

  • maintenance;
  • software updates;
  • hosting problems;
  • payment-provider outages;
  • security incidents;
  • internet failures;
  • events outside reasonable control.

Newcomer Circle NL will take reasonable steps to restore access but does not guarantee uninterrupted availability at all times.

19. Changes and corrections

Website content may be corrected, updated, expanded, or removed.

Minor corrections or updates may also be made to digital products, particularly where they improve accuracy, formatting, accessibility, or technical compatibility.

A purchase of one product edition does not automatically include:

  • future editions;
  • newly created products;
  • future courses;
  • additional services;
  • lifetime updates,

unless the product description expressly says otherwise.

20. External websites and services

The website may contain links to third-party websites or services, including:

  • Amazon;
  • YouTube;
  • Instagram;
  • LinkedIn;
  • Stripe;
  • government websites;
  • educational resources.

Newcomer Circle NL does not control external websites and is not responsible for their content, availability, privacy practices, prices, or terms.

A link does not necessarily mean that Newcomer Circle NL endorses every statement, product, or service on the external website.

21. Limitation of liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

To the extent permitted by law, Newcomer Circle NL is not responsible for indirect or consequential losses arising from:

  • reliance on general educational information;
  • failure to check current official requirements;
  • incompatible devices or software;
  • loss of a file after download;
  • incorrect customer contact information;
  • unauthorised account use;
  • interruption by an external service provider;
  • failure to achieve a particular examination, language, employment, immigration, or personal result.

Educational results depend on many factors, including the learner’s study time, prior knowledge, practice, and personal circumstances. No specific learning or examination result is guaranteed.

22. Force majeure

Newcomer Circle NL is not liable for delay or failure caused by circumstances reasonably outside its control.

These may include:

  • internet or hosting failure;
  • cyberattack;
  • power failure;
  • natural disaster;
  • government action;
  • illness or emergency;
  • disruption of payment or email services;
  • interruption of third-party platforms.

Obligations will resume as soon as reasonably possible.

23. Privacy

Personal information is handled in accordance with the Newcomer Circle NL Privacy Policy.

The Privacy Policy explains:

  • what information is collected;
  • why it is used;
  • which providers may process it;
  • how long it may be retained;
  • what privacy rights customers have.

The Privacy Policy is available separately on the website.

24. Complaints

  • the product name;
  • the order date;
  • a clear explanation of the issue;
  • relevant supporting information.

Newcomer Circle NL will aim to acknowledge and address complaints within a reasonable period.

25. Governing law

These Terms and Conditions are governed by Dutch law.

Consumers residing in another European Union country retain any mandatory consumer protections that apply to them under applicable law.

Disputes may be submitted to a competent court as determined by applicable law.

26. Severability

Where any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

The invalid provision will be interpreted or replaced as closely as possible in line with its original purpose and applicable law.

27. Changes to these Terms

These Terms and Conditions may be updated when:

  • products or services change;
  • new payment or access options are introduced;
  • website functionality changes;
  • applicable law changes;
  • service providers change.

The latest version will be published on this page with its revision date.

The version that applied when an order was placed will normally govern that order.
